APPLICABLE U.S. LAW - THREATENING INTERSTATE COMMUNICATIONS

Ohe of the emails received by the officer-involved domestic violence advocate also made reference to her family. By doing that, the sender has elevated the level of his or her offense to federal:

United States Code>
TITLE 18 - CRIMES AND CRIMINAL PROCEDURE>
PART I - CRIMES>
CHAPTER 41 - EXTORTION AND THREATS>
§ 875. INTERSTATE COMMUNICATIONS>

(c) Whoever transmits in interstate or foreign commerce any communication containing any threat to kidnap any person or any threat to injure the person of another, shall be fined under this title or imprisoned not more than five years, or both.

TAMPA An FBI SWAT team arrested a Seffner man this morning on a federal warrant issued in Virginia for "interstate threat." Larry Henry Borneisen, 51, was arrested at his home at 4607 Castlewood Road. Borneisen spoke on the phone to a Capital One call center in Virginia this weekend, and his issue escalated in a threatening way, FBI spokeswoman Dee Rybiski said. Rybiski refused to discuss what was said during Borneisen's call. "It was important enough for it to be handled this way," she said. Borneisen was taken to the United States Marshal Service in Tampa for processing, an FBI release states. Reporter Josh Poltilove can be reached at jpoltilove@tampatrib.com or (813) 259-7691.
